& COPYRIGHT LICENSING POLICY F.A.Q.
We
are offering the dedicated fans of VAN HALEN and its members
the opportunity to license the Frankenstein Design, Franky Design,
and Original Frank (collectively, "Artwork"), as well
as the VH logos for use on fan websites ONLY. Please
read the entire Trademark
& Copyright Licensing Policy ("Policy") carefully
to ensure that you fully understand all of the terms.
Here
are some Frequently Asked Questions:

What does the Policy let me do?
In
general, if you own a fan website, you may use the Artwork and
VH logos on your fan website. (Websites with the primary purpose
of selling anything are not eligible to make any use of the
Artwork and/or VH logos.)
2)
Why should I follow the Policy?
The
owner of a copyrighted work (such as the Frankenstein Design)
has the exclusive right, and exclusive ability to license to
others the right, to reproduce and distribute copies of the
work, prepare derivative works of the work, and display the
work publicly. The owner of a trademark (such as the VH logos)
has the right to protect against the unauthorized use of its
trademark, as well as the use of other marks that are confusingly
similar. Federally registered copyrights and trademarks enjoy
certain national rights, the infringement of which can trigger
substantial statutory fines and penalties.
The
copyright in the Frankenstein Design has been registered with
the U.S. Copyright Office. The VH logos have been registered
as trademarks with the U.S. Patent and Trademark Office. Unauthorized
use of the Artwork and/or VH logos is an infringement of these
intellectual properties, subjecting unauthorized users to potential
liability, fines and penalties.
By
following the terms of the Policy, we will not object to your
use of the Artwork and VH logos on your fan website.
By
following the terms of the Policy, we will not object to your
use of the Frankenstein Design and VH logos on a fan website.
3) Can I sell anything with the Artwork
or VH logos?
You
may not create and sell or distribute anything with the Artwork
and/or the VH logos. You also may not identify anyone, or include
links to other websites, that sell unauthorized goods/services
with the Artwork and/or the VH logos, VAN HALEN, or 5150 marks.
When in doubt, check with us first and we will let you know
if something is authorized.
4)
I've already invested in items with the Artwork and/or VH logos
that I want to sell. What can I do with my inventory?
Don't
worry - if you were selling these items in connection with your
fan website, you have until August 15, 2002 to sell or distribute
these items (so long as they were not guitars or guitar parts)
provided that they were in your possession and control as of
May 13, 2002. If you want to sell these items online, you can
only do it through your fan website.
5)
My fan website has a classifieds section that lets people
post
advertisements to buy and sell VAN HALEN related items, some
of which may have the VH logos, VAN HALEN, and/or 5150 marks.
Is this permitted?
You
may continue to have a classifieds section on your website where
people can buy and sell authentic items, so long as this is
not the primary purpose of your website.
In
respect to guitars - no one has ever been authorized to make
and sell or distribute any guitars with the Artwork.
6)
Can I get a license to sell goods with the Artwork and/or the
VH logos, VAN HALEN and/or 5150 marks?
Only
a few licenses for the sale of goods using these intellectual
property rights have been granted, and we do not presently anticipate
increasing the number of such licenses. We do not encourage
you to submit any ideas or concepts involving these intellectual
property rights - if you do, you will have waived all rights
to claim such ideas and concepts as your own.
